What types of data may be processed by MYCRANE DMCC?

We may process your website user account data ("account data"). The account data include your account identifier, name, email address, business name, account creation and modification dates, website settings and marketing preferences. The primary source of the account data is you and/or your employer.

We may process information contained in or relating to any communication that you send to us or that we send to you ("communication data"). The communication data may include the communication content and metadata associated with the communication. Our website will generate the metadata associated with communications made using the website contact forms.

The Site protects the Data that is automatically transmitted during the viewing of ad blocks and when visiting pages on which the system's statistical script ("pixel") is installed:

MYCRANE Marketplace - General Terms and Conditions

Welcome to MYCRANE Marketplace! These Terms and Conditions govern your use of the MYCRANE Marketplace platform (market.my-crane.com). By accessing or using our services, as well as on the website, you agree to be bound by these Terms and Conditions. All rights to the website belong to the company MYCRANE DMCC, a company organized and existing under the laws of the United Arab Emirates, having its registered address at Unit 2027, DMCC Business Centre, Level 1, Jewellery & Gemplex 3, Dubai, UAE.

TERMS

MYCRANE Marketplace (hereinafter – «marketplace’ or «platform») is an online platform designed for the placement, sale, purchase and rental of various equipment used in construction, industry, logistics and other sectors requiring the use of crane and lifting equipment. Marketplace is an intermediary providing interaction between sellers (suppliers) and buyers (customers), as well as providing additional services related to the sale and maintenance of equipment.

User - a natural or legal person or an individual entrepreneur who has registered on the Marketplace website. If the User of the site is an individual, then such user has the right to use the site only if he is 18 years old.

Account - an account created on the Marketplace website by the User.

Verified account - an account that has been verified by an official Marketplace Administration.

Marketplace Administration - is the operator of the platform, who manages its functioning, controls the placement of information, moderates offers, provides technical support to users and ensures the fulfilment of the conditions set out in these General Terms and Conditions.

The goods - offers to buy various types of cranes and related equipment and components, including but not limited to truck cranes, tower cranes, mobile cranes, hydraulic cranes, and other lifting equipment and parts.

1. SUBJECT

MYCRANE DMCC is the owner of the marketplace online platform (hereinafter referred to as «MYCRANE website») for the rental of cranes, this policy authorizes Users to exercise their civil rights to purchase goods posted directly on the marketplace.

The site is an online platform for buying and selling crane and lifting equipment. We provide users with the opportunity to purchase a variety of equipment for various fields of activity, including construction, industry and transport.

These terms and conditions define the terms of use of the site. The user agrees to the terms and conditions stated herein when visiting and using the site. If the User does not agree to these terms and conditions of General Terms and Conditions, the User must immediately stop using the MYCRANE website.

2. REGISTRATION AND ACCOUNT

Registering an account is a mandatory step to use all the Platform's functions, including placing orders, purchasing or renting equipment, as well as participating in other operations and functionalities offered by the Platform.

By registering, you agree not to:

Use the platform for personal, non-commercial purposes.

Reverse engineer or tamper with the platform's functionality.

Use bots, scrapers, or other automated tools to access the platform.

Misrepresent your identity or engage in fraudulent activities.

Violate any applicable laws or intellectual property rights.

By accessing and using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms of Use, which govern your access to and use of the Platform and its content.

If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must immediately cease using the Platform and its services.

Users who have completed the registration procedure undertake to comply with all the rules established by the Platform, including these regulations, the Privacy Policy and other applicable documents.

The registration procedure includes filling in the data of the User's future account. Upon completion of filling in the data requested by the Platform, the User should undergo account verification. Verification of the account may take up to 3 working days.

The User understands that without verification many features and services of the Platform will be restricted for use.

To register on the Platform, a potential user must be a capable natural or legal person who has the right to enter into transactions in his/her jurisdiction.

Persons under the age of 18 cannot register an account on the Platform without the consent of their legal representatives or guardians.

In case of registration of a legal entity, the representative must have appropriate authorization to register and manage the account on behalf of the company.

The potential user is obliged to provide true and complete information about himself or his organization.

When registering on the Platform, users are also required to create a unique login and password for their account.

In case of changes in the contact details or information provided during registration, the user is obliged to timely update the data in his/her account.

To register an account on the Platform, it is necessary to go through the account creation procedure via the registration form available on the main page of the Platform.

MYCRANE Marketplace - User Agreement

MYCRANE DMCC, organized and existing under the laws of the United Arab Emirates, registered at: Unit 2027, DMCC Business Centre, Level 1, Jewellery & Gemplex 3, Dubai, UAE, represented by Director Andrei Geikalo, acting under its Charter (hereinafter referred to as the "Organization") offers the Internet user (hereinafter referred to as the “User”), who is either an individual personally, or an individual authorized by a legal entity as designated by the User, to use the services of the site us.my- crane.com (hereinafter referred to as the “ Website “) on the terms set forth in this User Agreement (hereinafter referred to as the “Agreement”). The Agreement comes into force from the moment the User expresses consent to its terms in the manner provided for in clause 1 (d) of the Agreement.

1. General provisions

a. The Organization offers Users access to a wide range of Website services, including means of navigation, communication, search, placement and storage of various kinds of information and materials, offers, requests and postings (collectively, “content”), personalization of content, and transactions, including offers or requests related to Lifting Services or Lifting Equipment. “Lifting Services” shall include any services related to or arising from the use of Lifting Equipment, but shall exclude the sale of Lifting Equipment.

b. “Lifting Equipment” means vehicles, machinery, and related appurtenances, including, but not limited to: (i) self-propelled vehicles (tractors, road-building machines and other tracklessindependently-driven vehicles); (ii) lifting mechanisms, including those mounted on automotive chassis, special-automotive-type chassis, pneumatic wheeled and crawler-mounted lifting cranes; (iii) construction and industrial equipment and associated machinery; and (iv) tower cranes (a lifting crane with a high tower, a slewing boom and a lifting winch mainly used in construction). All currently existing services of the Organization's Website, the terms of use of which refer to this Agreement, as well as any development of them and/or the addition of new ones are the subject of this Agreement.

c. The use of the Website services is governed by this Agreement, as well as the following documents, which are an integral part of this agreement: the Privacy Policy, as well as the terms of use of individual Website services. The Agreement may be amended by the Organization without any special notice, the new version of the Agreement comes into force from the moment it is posted on the Internet at the address specified in this paragraph, unless otherwise provided by the new version of the Agreement. The current version of the privacy policy is always available on the website.

d. By starting to use the Website, any service of the Website / its individual functions, or going through the registration procedure on the Website, the User is considered to have accepted the terms of the Agreement in full, without any reservations and exceptions. If the User does not agree with any of the provisions of the Agreement, the User does not have the right to use the Services of the Website. If the Organization has made any changes to the Agreement in accordance with paragraph 1 (c) of the Agreement, with which the User does not agree, User is obliged to stop using the services of the Organization's Website.

2. User Registration. User Account

a. In order to use some of the services of the Organization's Website or some of the individual functions of the services of the Website, the User must complete the registration procedure, as a result of which a unique account will be created for the User.

b. In order to register, the User undertakes to provide reliable and complete information about himself and, if applicable, the legal entity he represents on the issues proposed in the registration form, and to keep this information up to date. If the User provides incorrect information or the Organization has reason to believe that the information provided by the User is incomplete or unreliable, the Organization has the right, at its discretion, to block or delete the User's account and refuse the User to use the services of the Organization's Website (or their individual functions). User shall be responsible for any and all damages, and shall indemnify and hold Organization harmless, from or related to. When registering, the User can upload an image for the account (avatar). The account image may accompany the materials published by the User as part of the use of the services of the Organization's Website. If the User's image is used as an account image, the User understands and agrees that the Organization has the right to publish and further use the User's image for use in the Organization's services, advertising products, corporate blogs and accounts of the Organization on third-party resources.

c. Account Confirmation i. The Organization reserves the right at any time to require the User to confirm the data specified during registration in the User account on the services of the Organization's Website and containing information about the User, as well as other information related to the use of the Organization's services available to the User after authorization using the User's login and password on the services of the Organization's Website. ii. For the purposes of verifying the data declared by the User, the Organization has the right to request supporting documents (in particular, documents certifying legal capacity / identity), including those provided for by the registration form, the failure of which, at the discretion of the Organization, may be equated to providing false information and entail the consequences provided for in clause 2 (b) of the Agreement. If the User's data specified in the documents provided by him does not correspond to the data specified during registration, as well as in the case when the data specified during registration does not allow identifying the User, the Organization has the right to deny the User access to the account and use of the Organization's services.

d. The User's personal information defined by the Privacy Policy and contained in the User's account is stored and processed by the Organization in accordance with the terms of the Privacy Policy (my-crane.com).

e. Means to access the User account. i. When registering, the User independently chooses a login (a unique symbolic name of the User account) and a password to access the account. The login is equal to the emailaddress used during registration. The organization has the right to prohibit the use of certain usernames, as well as to set requirements for login and password (length, allowed characters, etc.). ii. After the User logs in to the account, the account data can be automatically saved in the device browser until the User completes work under his account and does not require additional input of access means to the account each time the Organization's services are used. The User account data automatically saved in the device browser can be used to 3 access the services of the Organization's Website, including services, websites, applications and other software products of the Organization and other persons, except as specified in clause 2 (h,Ⅱ) of this Agreement.

f. The User is solely responsible for the security (including resistance to guessing) of the means chosen by him to access the account, and also independently ensures their confidentiality. The User is solely responsible for all actions (as well as their consequences) within or using the services of the Organization's Website under the User's account, including cases of voluntary transfer by the User of data for access to the User's account to third parties on any terms (including contracts or agreements). At the same time, all actions within or using the services of the Organization under the User account are considered to be performed by the User himself, except in cases when the User, in accordance with the procedure provided for in clause 2 (g), notified the Organization of unauthorized access to the services of the Organization using the User account and /or of any violation (suspicion of violation) of the confidentiality of their means of access to the account (mobile phone number, password or two-factor authentication means). User shall not share User’s username or password with anyone.

g. The User is obliged to immediately notify the Organization of any case of unauthorized (not authorized by the User) access to the Organization's services using the User account and / or of any violation (suspicion of violation) of the confidentiality of their means of access to the account. For security purposes, the User is obliged to independently perform a safe shutdown under his account (the "Exit" button) at the end of each session of work with the Organization's services. The Organization is not responsible for the possible loss or damage of data, as well as other consequences of any nature that may occur due to the User's violation of the provisions of this part of the Agreement.

h. The User's use of his account. i. The User does not have the right to reproduce, repeat and copy, sell and resell, as well as use for any commercial purposes any parts of the Organization's services (including content available to the User through the services), or access to them, except when the User has received such permission from the Organization, or when it is expressly provided by any service of the Website. ii. Certain categories of User accounts may restrict or prohibit the use of certain services of the Organization's Website or their individual functions if this is provided for during registration or in the terms of use of a particular service. i. Termination of registration. The organization has the right to block or delete the User account and deny access using any account to certain services of the Organization, and to delete any content without giving reasons including in case the User violates the terms and conditions of this Agreement or the terms of other documents specified in clause 1 (c) Agreement, and the failure of the service, in particular: i. if the User does not use their account in over one year. Or ii. if the User violates any term or condition of this Agreement or any other Agreement between User and Organization. j. Deleting a User account. i. The User has the right at any time to delete his account on all the services of the Organization or, if there is a corresponding function, to terminate it in relation to some of them. ii. The account is deleted by the Organization in the following order: 4 • the account is automatically blocked for a period of one month, during which the User's access to his account becomes impossible, while the content posted using such an account can be deleted; • if the User's account is restored by the User within the above period, access to the User's account will be restored, however, the content (applications, documents, records, comments, etc.) posted with its help may not be subject to restoration; • if the User's account is not restored within the above period, all content posted using it will be automatically deleted, and the login will be available for use by other users. From this moment on, it is impossible to restore the account, any information related to it, as well as access to the Organization's services using this account. iii. The procedure given in paragraphs 2(j,Ⅱ) of the Agreement (except for the availability of the login for use by other users) is also applicable to the prohibition of access using any account to certain services of the Website. 3. General provisions on use and storage. a. The Organization has the right to set restrictions on the use of the services for all Users, or for certain categories of Users (depending on the User's place of residence, the language in which the service is provided, etc.), including: the presence/absence of certain functions of the Website service, the shelf life of documents and messages in the Website service, any other content, the maximum number of documents and messages that can be sent or received by one registered user, the maximum size of a message, document or disk space, the maximum number of requests to the Website service for a specified period of time, the maximum storage period of content, special parameters of downloadable content, etc. An Organization can prohibit automatic access to the Website's services, as well as stop accepting any information generated automatically (for example, spam). b. The Organization has the right to send informational messages to its users. Using the Organization's services, the User also agrees to receive advertising messages. The user has the right to refuse to receive advertising messages by using the appropriate functionality of the service within which or in connection with which the user received advertising messages. The User agrees with the Organization to notify other Users of the Service about the User's public actions, including the posting of new publications, actions performed by him in relation to the Content of other Users, as well as other activities performed by him within the Service. c. In order to improve the quality of the Website's services, the Organization and /or the persons involved in conducting the survey have the right to collect opinions and feedback from Users on various issues by sending an information message when the User next visits the service or by contacting the contact details specified by the User in the account (via phone calls or emails). The collected opinions and reviews can be used to generate statistical data that can be used in the services of the Organization's Website. The reviews provided by the User during the survey can also be published by the Organization in the services of the Organization's Website, both with the User's name (login) and without it. When leaving feedback, the User undertakes to be guided by the requirements of this Agreement, including the requirements set forth in clause 5 of this Agreement.

4. User Content

a. The User is solely responsible for the compliance of the content posted by the User (including documents, information, data, bids, requests, offers, images, etc.) with the requirements of the current legislation, including liability to third parties in cases when the User posts this or that content (including documents, information, data, images, etc.) or the content of the content violates the rights and legitimate interests of third parties, including the personal non-property rights of the authors, other intellectual rights of third parties, and/or encroaches on the intangible benefits belonging to them.

b. The User acknowledges and agrees that the Organization is not obliged to view any kind of content posted and /or distributed by the User through the services of the Organization's Website, as well as that the Organization has the right (but not the obligation) at its sole discretion, refuse to post and/or distribute content to the User or remove any content that is available through the services of the Organization's Website. The User understands and agrees that he must independently assess all risks associated with the use of the content, including assessing the reliability, completeness or usefulness of this content.

c. The User understands and agrees that the technology of the Website services may require copying (reproduction) of the User's content by the Organization, as well as processing it by the Organization to meet the technical requirements of a particular service.

5. Terms of use of the Organization's Website services

a. The User is solely responsible to third parties for User’s actions related to the use of the Website Services, including if such actions lead to violation of the rights and legitimate interests of third parties, as well as for compliance with the law when using the Website Service.

b. When using the Organization's services, the User does not have the right and shall not: i. upload, send, transmit or in any other way post and/or distribute content that is illegal, malicious, defamatory, offends morality, demonstrates (or is propaganda) of violence and cruelty, violates intellectual property rights, promotes hatred and/or discrimination of people on racial, ethnic, sexual, religious, social grounds, contains insults against any persons or organizations, contains elements (or is propaganda) of pornography, eroticism, it is an advertisement (or is propaganda) of sexual services (including under the guise of other services), explains the procedure for the manufacture, use or other use of narcotic substances or their analogues, explosives or other weapons; ii. violate the rights of third parties, including minors, and/or harm them in any form; iii. impersonate another person or a representative of an organization and/or community without sufficient rights, including employees of the Organization, moderators of forums, the owner of the Website, as well as use any other forms and methods of illegal representation of other persons on the network, as well as mislead users or the Organization about the properties and characteristics of any subjects or objects; iv. upload, send, transmit or in any other way post and/or distribute content, in the absence of rights to such actions under the law or any contractual relationship; v. upload, send, transmit or in any other way post and/or distribute advertising information, spam, lists of other people's email addresses, pyramid schemes, multilevel (network) marketing (MLM), Internet earnings and e-mail business systems, "letters of happiness", as well as use the services of the Organization's Website to participate in these events, or use the services of the Organization's Website solely to redirect users to pages of other domains; vi. upload, send, transmit or in any other way post and/or distribute any materials containing viruses or other computer codes, files or programs designed to disrupt, destroy or limit the functionality of any computer or telecommunications equipment or programs for unauthorized access, as well as serial numbers to commercial software products and programs for their generation, logins, passwords and other means for obtaining unauthorized access to paid resources on the Internet, as well as posting links to the above information; vii. unauthorized collection and storage of personal data of other persons; viii. disrupt the normal operation of the websites and services of the Organization's Website; ix. facilitate actions aimed at violating the restrictions and prohibitions imposed by the Agreement; x. otherwise violate the norms of legislation, including the norms of international law; xi. circumvent Organization in the acceptance or offering of any requests to obtain or offers to supply Lifting Equipment or Lifting Services.

6. Exclusive rights to the content of the Organization's Website services and content

a. All objects accessible through the services of the Organization's Website, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds and other objects (hereinafter referred to as the content of the services), as well as any content posted on the services of the Organization, are objects of the exclusive rights of the Organization, Users and other copyright holders.

b. The use of the content, as well as any other elements of the Website services, is possible only within the framework of the functionality offered by this or that Website service. No elements of the content of the services of the Organization's Website, as well as any content posted on the services of the Organization's Website, may be used in any other way without the prior permission of the copyright holder. Usage means, among other things: reproduction, copying, processing, distribution on any basis, display in a frame, etc. Exceptions are cases directly provided for by the legislation of the UAE or the terms of use of a particular service of the Organization's Website. The User's use of elements of the content of the services, as well as any content for personal non-commercial use, is allowed provided that all copyright, related rights, trademarks, other notices of authorship are preserved, the name (or pseudonym) of the author/ name of the copyright holder is preserved unchanged, and the corresponding object is preserved unchanged. Exceptions are cases directly provided for by the legislation of the UAE or user agreements of a particular service of the Organization's Website.

7. Third-party websites and content

a. The services of the Organization's Website may contain links to other sites on the Internet (thirdparty sites). These third parties and their content are not checked by the Organization for compliance with certain requirements (reliability, completeness, legality, etc.). The Organization is not responsible for any information, materials posted on third-party sites that the User accesses using the Website's services, including for any opinions or statements expressed on third-party sites, advertising, etc., as well as for the availability of such sites or content and the consequences of their use by the User.

b. A link (in any form) to any website, product, service, any commercial or non-commercial information posted on the Website does not constitute an endorsement or recommendation of these products (services, activities) on the part of the Organization, except in cases where this is explicitly indicated on the resources of the Organization.

8. Advertising on the services of the Organization's Website

a. The Organization is responsible for advertising placed by it on the services of the Organization's Website, within the limits established by the legislation of the UAE.

b. The User agrees to receive information about events, conferences, trainings and other information from the Organization to the email address specified during registration.

9. Agreements made through or in connection with the Website or Services

a. To the extent User is a Supplier of Lifting Services or Lifting Equipment, User acknowledges and agrees to abide by any and all binding agreements between User and a customer which has agreed to User’s terms or conditions for provision of the Lifting Services or Lifting Equipment.

b. To the extent User is a customer seeking Lifting Services or Lifting Equipment, User acknowledges and agrees to abide by any and all binding agreements between User and a supplier which has agreed to User’s terms or conditions for provision of the Lifting Services or Lifting Equipment.

c. User shall not circumvent Organization in pursuing any leads for Lifting Services or Lifting Equipment learned of through the Services or Website.

d. User shall indemnify, defend, and hold Organization harmless for any breach of this Section 9.

10. No warranty, limitation of liability

a. The User uses the services of the Organization's Website at his own risk. The services are provided "as is". The Organization does not assume any responsibility, including for the compliance of the Website's Services with the User's goals;

b. The Organization does not guarantee that: the Website services meet /will meet the User's requirements; the services will be provided continuously, quickly, reliably and without errors; the results that can be obtained using the services will be accurate and reliable and can be used for any purpose or in any capacity (for example, to establish and/or confirm any facts); the quality of any product, service, information, etc. obtained using the Website services will meet the User's expectations;

c. Any information and / or materials (including downloadable software, letters, any instructions and guides to action, etc.) that the User gets access to using the services of the Organization's Website, the User can use at his own risk and is solely responsible for the possible consequences of using the specified information and / or materials, including for the damage that this may cause to the User's computer or third parties, for data loss or any other harm;

d. The Organization is not responsible for any kind of losses that occurred as a result of the User's use of the services of the Organization's Website or individual parts / functions of the services of the Organization's Website.

e. Organization shall not be responsible for any Lifting Services or Lifting Equipment. Any claim related thereto shall be solely between User and the party either (1) providing to User such Lifting Services or Lifting Equipment or (2) to whom User is providing such Lifting Services or Lifting Equipment, as applicable under the circumstances.

f. NO LIABILITY FOR CONSEQUENTIAL OR INDIRECT DAMAGES. EXCEPT LIABILITY FOR INDEMNIFICATION, IN NO EVENT SHALL EITHER PARTY OR ITS REPRESENTATIVES BE LIABLE FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF OR RELATING TO ANY BREACH OF THE AGREEMENT CONCLUDED BY A COMPANY AND A USER VIA THE PLATFORM, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT IT WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE.

g. MAXIMUM LIABILITY FOR DIRECT DAMAGES. IN NO EVENT SHALL LISTING MYCRANE’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE AGREEMENT CONCLUDED BY A SUPPLIER AND A CUSTOMER VIA THE PLATFORM, WHETHER ARISING OUT OF OR RELATED TO BREACH OF THE AGREEMENT CONCLUDED BY A SUPPLIER AND A CUSTOMER VIA THE PLATFORM, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE TOTAL OF THE AMOUNTS PAID TO LISTING SUPPLIER PURSUANT TO THE AGREEMENT CONCLUDED BY A SUPPLIER AND A CUSTOMER VIA THE PLATFORM OR $5,000, WHICHEVER IS LESS.

11. Other provisions

a. This Agreement is an agreement between the User and the Organization regarding the use of the services of the Organization's Website and replaces all previous agreements between the User and the Organization.

b. This Agreement is governed by and interpreted in accordance with the laws of the UAE and, particularly, Dubai. Issues not regulated by this Agreement are subject to resolution in accordance with the legislation of the UAE. All possible disputes arising from the relations regulated by this Agreement shall be resolved in accordance with the procedure established by the current legislation of the UAE and Dubai. Throughout the text of this Agreement, unless explicitly stated otherwise, the term "legislation" means the laws, rules, or regulations of the UAE, the Dubai, and any other applicable laws.

c. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability does not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. Upon a determination that any term or provision is invalid, illegal, or unenforceable, the Parties shall negotiate in good faith to modify this Agreement to effect the original intent of the Parties as closely as possible in order that the transactions contemplated hereby be consummated as originally contemplated to the greatest extent possible.

d. No waiver under this Agreement is effective unless it is in writing, identified as a waiver to this Agreement, and signed by an authorized Representative of the Party waiving its right. Any waiver authorized on one occasion is effective only in that instance and only for the purpose stated, and does not operate as a waiver on any future occasion. Neither of the following constitutes a waiver or estoppel of any right, remedy, power, privilege, or condition arising from this Agreement: (i) any failure or delay in exercising any right, remedy, power, or privilege or in enforcing any condition under this Agreement; or (ii) any act, omission, or course of dealing between the Parties.

e. Dispute Resolution. i. Good faith Negotiations. In the event of a dispute arising out of or relating to this contract, including any question regarding its breach, existence, validity or termination, and including any non-contractual claims (whether in tort or otherwise) (“Dispute”), the parties shall endeavor to reach a resolution of the Dispute satisfactory to both parties. Either party may commence such process by requesting a meeting with the other party, which may take place in person, or remotely. Each party shall nominate a representative who shall meet to try to resolve the Dispute. ii. Mandatory Mediation. If the Dispute is not resolved within 10 business days following the meeting between the parties’ representatives, the Parties shall undertake to mediate the Dispute before an agreed upon mediator, with both parties to split the cost of the mediator. This mediation is mandatory. iii. Binding Arbitration. If the Parties fail to resolve the Dispute within 30 days of the mediation, the Dispute shall then be resolved by final and binding arbitration. Claims shall be heard by a single arbitrator. The place of arbitration shall be Dubai, UAE. The arbitration shall be governed by the laws of the UAE. Pursuant to the Commercial Arbitration Rules, the arbitrators will have the authority to allocate the costs of the arbitration process among the parties, but will only have the authority to allocate attorneys' fees if a particular law permits them to do so. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. The parties agree that failure or refusal of a party to pay its required share of the deposits for arbitrator compensation or administrative charges shall constitute a waiver by that party to present evidence or cross-examine witness. In such event, the other party shall be required to present evidence and legal argument as the arbitrator(s) may require for the making of an award. Such waiver shall not allow for a default judgment against the non-paying party in the absence of evidence presented as provided for above.

MYCRANE Marketplace - Seller Policy

This policy regulates the general terms and conditions of the Platform for sales issues. If the Seller does not agree to these terms and conditions of buyer policy, the User must immediately stop using the MYCRANE website.

MAIN PROVISIONS

1.1. MYCRANE DMCC is the owner of the marketplace online platform (hereinafter referred to as «marketplace» or «MYCRANE website» or «MYCRANE platform») for the rental of cranes, this policy authorizes Users to exercise their civil rights to purchase goods posted directly on the marketplace
1.2. Seller - is any person who has registered on MYCRANE website, who may be a natural person, a legal entity (including all types and forms provided by other laws on commercial and non-commercial entities) or a Sole Proprietorship, has crane or other lifting equipment by right of ownership or title. Is a bona fide party to the sale and purchase relationship.
1.3. Account verification - is the verification of the Seller's account by an official MYCRANE manager of the department responsible for account verification.
1.4.1. To initiate verification, the Seller must provide the following documents: ID card (when registering an individual entrepreneur account), which can be any document that refers to this type of document, as defined by the laws of the country of citizenship of the Seller. The Seller also undertakes to provide all necessary documentation confirming the bona fide ownership of the equipment.
1.5. If the Seller does not agree to these terms and conditions of Seller policy, the Seller must immediately stop using the MYCRANE website.
1.5.1. The Seller expresses his/her consent by performing specific actions on the MYCRANE platform, such as: registering an account, accepting the General Terms and Conditions, using the site to search for a potential selling, to explore the trading market, and for any other purpose that directly involves the MYCRANE platform.
1.6. The goods in this provision are the offers to buy truck cranes, tower cranes, mobile cranes, crawler cranes, overhead cranes, gantry cranes, manipulators, crane rigs, jib cranes, hydraulic cranes, crane machines, pneumatic cranes, crane manipulators, telescopic cranes, crane platforms, transfer cranes, crane tractors, mini cranes, pneumatic cranes, stacker cranes, suspension cranes, lift trucks, crane winches, crane carts, semi-trailers with crane, mobile cranes, crane units, logging cranes, front loaders with crane, crane erection systems, without limitation, as well as a category of goods, representing service mechanisms and components (spare parts) for lifting and crane equipment, such as elevator trucks, tractor-trailers, hydraulic pumps, winches, carriages, swivels, hydraulic cylinders, ropes and cables, brake systems, pneumatic components, safety systems, manipulators, telphers, electrical systems, service platforms, truck elevators, elevators, brackets, filters, hoses, pumps, batteries, control panels, tracks, brake pads, gaskets, gears, hydraulic fluids, belts, air filters, levers, baseplates, welders, boom parts, axle and wheel components, control valves, cooling systems, electric motors, load limiters, stabilizers, guards and enclosures.

2. RIGHTS AND OBLIGATIONS OF MYCRANE PLATFORM

2.1. The MYCRANE Platform has the right to conduct verification of sellers, including verification of their identity and activities. This may include requesting documents confirming ownership of goods, licences, tax documents, as well as certification that the seller has the legal right to sell equipment. The platform may request additional details or conduct a verification of information provided by the seller, including their transaction history.
2.2. The MYCRANE Platform has the right to set requirements for the description and photos of the goods posted by the seller, as well as other criteria that relate to the quality of content and information. The MYCRANE Platform may reject the goods if they do not meet these standards or require their revision.
2.3. The MYCRANE Platform may set minimum or maximum price limits for goods (e.g. through an auction or fixed price listing) and has the right to adjust or reject sellers' offers if the prices of goods deviate significantly from market norms or violate the rules set by the Platform.
2.4. The MYCRANE Platform has the right to remove or suspend the listing of goods, as well as block the accounts of sellers who violate the terms of use, rules of behaviour or laws. The platform can also block the seller if his goods do not meet technical standards or have problems with documents.
2.5. Equipment is sold "as is, where is." Visit the equipment location to inspect before purchase or send someone to do so on your behalf. Refer to our Buyer Manual for inspection details.
2.6. The MYCRANE Platform has the right to moderate and remove reviews that are false, offensive or violate the rules. It may also block or restrict access to the ability to leave reviews for sellers with a bad reputation or fraudulent behaviour.
2.7. The MYCRANE Platform has the right to make changes to the rules of use, terms of sale and product placement, including with regard to commissions, payment terms, delivery, and other terms and conditions relating to sellers. These changes may be implemented with prior notice to sellers.
2.8. The MYCRANE Platform may request that the quality and compliance of goods with standards be checked. If discrepancies are found, it may require the seller to rework, return the goods or refuse the sale.
2.9 The MYCRANE Platform has the right to block funds on sellers' accounts, if there are suspicions of fraud, breach of terms and conditions or if the goods have not been delivered or do not meet the declared characteristics. The MYCRANE Platform may delay or withhold payment to the seller until the investigation is completed.
2.10 The MYCRANE Platform may appoint third parties to perform a number of functions, such as delivery of goods, logistics, quality control and certification of technology, as well as resolving disputes. The MYCRANE Platform may establish and modify the terms and conditions of interaction with these third parties, including the engagement of their services without the prior consent of the seller.
2.11. The MYCRANE Platform has the right to establish the rules of return and warranty for the goods sold through the site, as well as to authorise or reject the claims of buyers if they do not meet the standards of the MYCRANE Platform. The platform may require the seller to fulfil the obligation to return or replace the goods if the goods do not meet the stated characteristics.
2.12. The MYCRANE Platform may suspend or delete a seller's account if the seller violates the terms of the agreement, provides false information or engages in fraudulent activities. The MYCRANE Platform may also remove products that do not meet the established standards or product categories.
2.13. The MYCRANE Platform has the right to restrict the functionality of the seller's account, for example, to restrict the ability to post new products or execute transactions if the seller violates the terms of use or has unpaid debts.
2.14. The MYCRANE Platform has the right to collect and use seller data, including information about sales, statistics, ratings, reviews, and other information for analysis, service improvement, marketing purposes and promotion on the MYCRANE Platform.
2.15. The MYCRANE Platform may provide sellers with promotion, marketing or advertising services on the platform. The MYCRANE Platform has the right to set rules for the use of these services and to charge additional fees for such features.
2.16. The MYCRANE Platform has the right to act as a mediator in case of a dispute between a seller and a buyer. However, it is not responsible for the contractual obligations of the parties and can only intervene at its sole discretion. In case of breach of terms and conditions or detection of abuse, the platform has the right to take action against the seller.
2.17. The MYCRANE Platform is obliged to provide sellers with access to the site functionality for product placement, account management and communication with buyers. This includes ensuring stable operation of the site, availability of the interface for sellers and functionality for order processing.
2.18. The MYCRANE Platform is obliged to provide sellers with a simple and convenient interface for posting information about goods (lifting equipment and cranes), including adding descriptions, photos, prices and other data necessary for successful sale.
2.19. The MYCRANE Platform is obliged to inform sellers about the rules of using the service, including the terms of posting goods, content requirements, commissions and other important aspects. These rules must be clearly stated and available for familiarization.
2.20. The MYCRANE Platform is obliged to ensure the protection of personal data of sellers, complying with the norms of legislation in the field of personal data protection. The MYCRANE Platform shall use reliable methods to protect accounts and data transmitted through the site.
2.21. The MYCRANE Platform is obliged to provide sellers with access to technical support to solve questions and problems arising in the process of using the site. The responsibility for support is limited only to technical aspects of the platform and does not extend to issues related to the quality of goods or transactions.

3. RIGHTS AND OBLIGATIONS OF SELLERS

3.1. Sellers have the right to place their goods (hoisting and crane equipment) on the MYCRANE Platform in accordance with the rules established by the platform. Goods must meet the quality and safety criteria stipulated by law.
3.2. Sellers have the right to manage their account on the platform, including updating product information, changing prices, accessing sales statistics and processing orders, as well as the ability to edit or delete their listings.
3.3. Sellers have the right to have access to complete and clear rules for the use of the MYCRANE Platform, including on product placement, service fees, payment and delivery. These rules must be accessible and understandable.
3.4. Sellers have the right to use all available tools of the MYCRANE Platform to successfully place goods, promote them in search engines of the MYCRANE Platform and get feedback from buyers. The MYCRANE Platform provides basic tools, but additional features may be paid.
3.5. Sellers have the right to access reports and analytics on their goods, sales, feedback and other data that will help evaluate the effectiveness of their trading on the MYCRANE Platform.
3.6. Sellers have the right to access the MYCRANE Platform support service to solve technical issues or questions related to the use of the site, placement of goods, payment processing and other aspects of the MYCRANE Platform.
3.7. Sellers have the right to refuse to conclude a transaction until the completion of the purchase (payment) or for other reasons, if it does not contradict the conditions of the MYCRANE Platform or the law.
3.8. Sellers have the right to change the price of goods or terms of sale, with these changes coming into effect from the moment they are updated on the MYCRANE Platform, if this does not violate the established rules.
3.9. Sellers have the right to confidentiality of their personal data and information about sales. The MYCRANE Platform is obliged to protect this data in accordance with data protection laws.
3.10. Sellers have the right to withdraw their goods from the platform if they cannot fulfill the conditions of sale or if the goods do not meet the stated characteristics.
3.11. Sellers have the right to be protected against illegal actions by buyers, such as fraud or attempts to violate the terms of sale. In the event of a dispute with the buyer, sellers can seek the help of the MYCRANE Platform to resolve the problem.
3.12. Sellers are entitled to a refund or compensation in case of violation of the terms and conditions of the MYCRANE Platform, for example, if their account is wrongfully blocked or if they cancel a sale not agreed with the seller.
3.13. Sellers are obliged to provide accurate, complete and up-to-date information about the goods, including technical specifications, photo, description, country of production, year of manufacture, condition of the goods and other data that may influence the buyer's decision. The seller must ensure that all information about the product is true and correct. The Seller sells the equipment as it is, at the place of its location.
3.14. Sellers are obliged to sell only equipment that meets the quality, safety and technical standards established by law. The equipment must be in good working order and have all necessary documents (certificates, passports, licenses) confirming its compliance with regulations.
3.15. Sellers are obliged to comply with the terms of sale that were established at the time of placing the goods on the platform. This includes the correct indication of the price, delivery terms, warranty and return conditions. Changes to the terms and conditions must be agreed with the MYCRANE Platform in advance.
3.16. Sellers are obliged to provide all necessary documents for the equipment, including documents confirming the ownership or legality of the sale (e.g. transfer deed, sales contract, registration certificates of the equipment, technical passports, etc.). Without these documents the machinery cannot be placed on the MYCRANE Platform.
3.17. Sellers are obliged to check the technical condition of the equipment before placing it on the platform. All defects, damages or malfunctions must be indicated in the description of the goods. Sellers are liable for faults that were not specified in the product information.
3.18. The Sellers are obliged to provide a warranty for the sold equipment in accordance with the legislation and the terms and conditions of the MYCRANE Platform. In case the equipment is subject to warranty service, sellers are obliged to ensure its fulfillment.
3.19. Sellers are obliged to provide buyers with all necessary information for a safe transaction, including accurate payment details, delivery methods and contact details for communication. Sellers shall observe confidentiality and shall not disclose personal data of buyers without their consent.
3.20. Sellers are obliged to comply with all rules and requirements established by the MYCRANE Platform, including the terms of product placement, pricing policy, content quality standards, as well as participation in dispute resolution in case of conflict situations with buyers.
3.22. Sellers are required to notify buyers in advance of any known defects or limitations that may affect the performance or use of the appliances. This includes malfunctions requiring repair or modifications that may affect performance.
3.23. Sellers shall comply with all applicable environmental regulations and laws regarding the disposal and operation of the equipment. The seller must ensure that the equipment sold does not violate environmental standards and has all necessary permits for operation.
3.24. Sellers are obliged to timely pay all commissions established by the MYCRANE Platform for the use of services (placement of goods, promotion, etc.), as well as any other payments that may arise in the process of trading.
3.25. Sellers are obliged to act in good faith and not to mislead buyers, not to use deceptive sales or marketing methods, and not to manipulate reviews and ratings
3.26. Users must register with accurate details. Multiple accounts by the same user are prohibited. MYCRANE reserves the right to suspend or terminate accounts violating policies

4. PAYMENT

4.1. For providing access to the MYCRANE Platform and the ability to place ads for the sale of cranes, sellers are required to pay the platform a fee of 3% of the final price of the crane sold, including taxes.
4.2. Commission payment terms: The commission for the use of MYCRANE Platform is paid in proportion to the deposited funds of the buyer.
4.3. The MYCRANE Platform reserves the right to change the amount of commission by giving 30 days prior notice to the seller before the changes take effect. Changes will be published on the platform and notified to sellers through their personal accounts.
4.4. In case the buyer returns the goods or cancels the transaction, the commission for the sold goods is non-refundable, unless the return is due to platform errors. The Seller is obliged to pay the commission even if the transaction is canceled or the goods are returned.
4.5. The Seller is responsible for all taxes and fees related to the sale of the cranes. The MYCRANE Platform is not a tax agent and the responsibility for paying taxes falls solely on the seller.
4.6. MYCRANE is not a party to transactions between buyers and sellers. Sellers must ensure product ownership and the ability to transfer clear titles. MYCRANE is not liable for payment disputes between buyers and sellers.

5. FRAUD PREVENTION METHODS

5.1. The MYCRANE platform may require users (buyers and sellers) to undergo verification procedures, including verification of personal data such as passport details, TIN, company details (for legal entities), as well as confirmation of contact information (phone, email). This eliminates the possibility of registering fake or fraudulent accounts.
5.2. To enhance security, the platform can implement two-factor authentication (2FA), which requires the user to confirm their identity through an additional channel (e.g. SMS code or authentication app) when logging into a personal account or making payments.
5.3. The MYCRANE platform may use automated systems to monitor transactions that analyse user behaviour and identify suspicious activities, such as unusual purchase volumes, frequent returns or unsubstantiated complaints. If such activities are detected, the platform may temporarily block the account or conduct additional verification.
5.4. To prevent payment fraud, the MYCRANE platform may use systems that track and analyse suspicious transactions, such as attempts to make payments using stolen cards or false credentials. A system of pre-screening and blocking of suspicious payment data can also be introduced.
5.5. The MYCRANE platform may implement a rating and feedback system for buyers and sellers. The system will rate the honesty and reputation of participants based on transaction history, which will help to watch out for scammers and fraudulent sellers. The platform can also block accounts with bad reviews or suspicious activity.
5.6. The MYCRANE platform may implement a procedure to verify goods posted on the platform for compliance with the stated characteristics and standards. Sellers are required to provide accurate product information, and falsification of characteristics or attempts to sell non-existent goods will be discouraged.
5.8. The MYCRANE platform can regularly inform users about typical fraud schemes (e.g., via email or notifications in their personal accounts), warning them against unreliable actions. It is also important to provide the possibility to quickly block suspicious accounts.
5.9. The MYCRANE platform can set strict rules on returning goods, obliging sellers to provide clear terms of return and guarantees. In case of disputes, the MYCRANE platform can help the buyer to get a refund or exchange the goods, subject to buyer protection conditions.
5.10. The MYCRANE platform can implement a system to monitor users' IP addresses and geolocation to prevent fraud related to false orders or attempts to use fake accounts for manipulation.
5.11. The MYCRANE platform can integrate external anti-fraud systems that analyse and prevent fraud by using algorithms to identify suspicious activity based on transaction data, geographical location and other parameters.
5.12. The MYCRANE platform can provide users with security materials and advice, such as how to recognise fraudulent schemes, how not to disclose personal data or banking information, and how to act in case of suspected fraud.
5.13. Listings may be screened before being published. MYCRANE may conduct random quality checks to verify listing accuracy. MYCRANE reserves the right to remove listings that violate our policies. Unsolicited marketing or misuse of contact information may lead to account suspension.

6. AUCTION RULES

Auction Opening:
6.1. Auction Registration:
Registration for the auction is free.
A refundable bid deposit may be required before auction.
All bidders must present valid photo identification before the auction (e.g., passport, driver’s license, or identity card) to complete registration.
The auction for the sale of lifting and crane equipment is opened by posting information about it on the MYCRANE platform. The seller or the organiser of the auction creates a lot, which includes a full description of the goods, their characteristics, initial price, auction terms and conditions of participation.
All items are sold to the highest bidder on auction day, with no minimum bids or reserve prices.
Sellers are strictly prohibited from bidding on their own items.
Bids are irrevocable, and all sales are final.
If you are the highest bidder when the auctioneer announces that an item has been sold, you become the new owner of that item.
6.2 Documents for participation:
For the auction, the seller must provide the following documents:

  • Description of the goods (hoisting equipment or crane), including technical specifications, equipment passport, photos.
  • Proof of ownership or legality of sale of the goods.
  • Warranty and return conditions (if applicable).
  • Price restrictions or minimum price threshold, if any.

All items are sold "as is, where is."
We strongly encourage bidders to inspect items before placing bids.
You may appoint a representative to inspect items on your behalf before the auction.
6.3 User Notification:
A few days before the start of the auction, a notification is posted on the platform for registered verified users, which contains all important details: date and time of the auction start, starting price, description of goods and conditions of participation. All registered users will receive notifications by email or via their personal cabinet.
Auction procedure:
6.4 Timing of the auction:
The auction begins at a certain time and date specified in the lot conditions and continues for 3 to 14 calendar days, depending on the conditions of the particular auction. The period may be extended if the auction organiser decides to extend the bid submission period.
6.5 Bidding Conditions:
Bidders can bid on goods (lifting equipment or crane) through the MYCRANE platform. The minimum bid must exceed the previous bid by a set amount or a percentage determined by the auction organiser (e.g. minimum 1% of the current bid or a fixed amount). Bidders may place an unlimited number of bids during the entire auction period.
6.6 The method of raising bids:
Bidders bid on an item in the auction. Each new bid must be higher than the previous one by a minimum amount. The auction is conducted in real time and all participants can see the current bids (without disclosing the winner until the auction is over).
6.7 Eligibility:
To participate in the auction, the buyer must be registered on the MYCRANE platform, have a positive reputation and fulfil all the requirements specified in the rules. The bidder must prove his/her identity or provide documents if required by the auction organiser.
The Seller has the right to participate in the auction on equal terms with other registered participants, if he complies with all the rules and requirements established by the MYCRANE platform. To participate in the auction, the Seller must be registered on the MYCRANE platform, be verified and have a confirmed ability to pay.
6.8. The Seller has the right to participate in the auction on the MYCRANE platform for the sale of his crane or loading equipment by placing the goods in compliance with all the established rules and conditions of the platform.
6.8.1. The Seller has the right to set a starting price for his lot in the auction, which will serve as the minimum price for the start of bidding. The price may be changed before the start of the auction within the auction conditions.
6.8.2. The Seller has the right to change the auction conditions (e.g. price or description of the lot) before the auction, provided that such changes do not violate the rules of the MYCRANE platform and terms of the auction.
6.8.3. The Seller has the right to receive notifications about the auction progress, bids and actions of buyers, as well as about the end of the auction, the winner of the auction and other important events related to his lot.
6.8.4. The Seller may cancel his lot or withdraw from the auction before the auction starts, provided that it complies with the rules of the MYCRANE platform and does not violate the interests of buyers.
6.8.5. The Seller has the right to protect its interests, including the right to block unscrupulous buyers, if they violate the rules of the auction or behave inappropriately.
6.8.6. The Seller has the right to seek the assistance of the MYCRANE platform to resolve disputes with buyers if any arise during the auction.
6.8.7. The seller's obligations:
6.8.8. The seller must provide an accurate description of the equipment (crane or loader), including technical specifications, condition, year of manufacture, country of manufacture, defects and other important data that may affect the buyer's decision.
6.8.9. The Seller is obliged to comply with all terms and conditions of participation in the auction, established by the MYCRANE platform, including the rules of the beginning and end of the auction, minimum bid steps, payment and delivery terms.
6.8.10. The Seller undertakes to ensure that the sold equipment is in good technical condition, corresponds to the declared characteristics and has no hidden defects of which the buyer has not been notified.
6.8.11. The Seller is obliged to fulfill all conditions specified in the auction lot, including price, delivery terms, warranties, return conditions and other contractual obligations.
6.8.12. The Seller is obliged to comply with all applicable consumer protection laws, as well as relevant safety, quality and environmental standards when selling the equipment.
6.8.13. The Seller is obliged to ensure the safety of the transaction, including the correct execution and transfer of all necessary documents for the equipment, as well as fulfillment of the terms of delivery and payment.
6.8.14. The Seller is obliged to participate in the process of dispute resolution with the Buyer, if any. The Platform may provide opportunities for mediation, but is not obliged to act as a party to the dispute.
6.8.15. The Seller undertakes to comply with the terms of fulfillment of the transaction, including delivery of the equipment to the buyer within the agreed terms. In case of violation of these terms, the seller may be subject to penalties or his account may be blocked.
6.8.16. The Seller is obliged to timely pay the MYCRANE platform 's commission in the amount specified in the terms and conditions for participation in the auction. The MYCRANE platform charge a commission for placing a lot or for a successful transaction (after the sale of goods).
6.8.17. The Seller is obliged to keep records of all transactions, sales, received payments and expenses, as well as to provide the necessary reporting to the MYCRANE platform upon request.

TERMS AND DEFINITIONS:
MYCRANE DMCC is the owner of the marketplace online platform (hereinafter referred to as «marketplace» or «MYCRANE website» or «MYCRANE platform») for the rental of cranes, this policy authorizes Users to exercise their civil rights to purchase goods posted directly on the marketplace.
Buyer - is any person who has registered on MYCRANE website, who may be a natural person, a legal entity (including all types and forms provided by other laws on commercial and non-commercial entities) or a Sole Proprietorship.
The Buyers' right to purchase arises from the moment of account verification.
Account verification - is the verification of the Buyer's account by an official MYCRANE manager of the department responsible for account verification. The Buyer expresses his/her consent by performing specific actions on the MYCRANE platform, such as: registering an account, accepting the General Terms and Conditions, using the site to search for a potential purchase, to explore the trading market, and for any other purpose that directly involves the MYCRANE platform.
The goods in this provision are the offers to buy truck cranes, tower cranes, mobile cranes, crawler cranes, overhead cranes, gantry cranes, manipulators, crane rigs, jib cranes, hydraulic cranes, crane machines, pneumatic cranes, crane manipulators, telescopic cranes, crane platforms, transfer cranes, crane tractors, mini cranes, pneumatic cranes, stacker cranes, suspension cranes, lift trucks, crane winches, crane carts, semi-trailers with crane, mobile cranes, crane units, logging cranes, front loaders with crane, crane erection systems, without limitation, as well as a category of goods, representing service mechanisms and components (spare parts) for lifting and crane equipment, such as elevator trucks, tractor-trailers, hydraulic pumps, winches, carriages, swivels, hydraulic cylinders, ropes and cables, brake systems, pneumatic components, safety systems, manipulators, telphers, electrical systems, service platforms, truck elevators, elevators, brackets, filters, hoses, pumps, batteries, control panels, tracks, brake pads, gaskets, gears, hydraulic fluids, belts, air filters, levers, baseplates, welders, boom parts, axle and wheel components, control valves, cooling systems, electric motors, load limiters, stabilizers, guards and enclosures.

1.RIGHTS AND OBLIGATIONS OF MYCRANE PLATFORM
1.1.The owners of the website act solely as a platform for the posting of goods and services, providing users with the opportunity to buy or rent goods posted on the website. The site owners are not responsible for the quality, availability, delivery times and other aspects of transactions between buyers and sellers.
1.2.The owners of the site have the right to any modification, adjustment or deletion of prices offered by sellers or suppliers on the platform. Prices may be changed at any time and without prior notice to users. Owners may introduce discounts, promotions or change the price of goods at their sole discretion.
1.3.The owners of the site have the right to refuse to conclude a transaction or reject a purchase request without giving reasons. The platform may suspend or cancel any transaction if it deems that it violates the site's terms of use or violates the law.
1.4.Site owners have the right to set and change the terms and conditions of purchase, including minimum and maximum amounts for checkout, payment methods, shipping and returns. These terms and conditions may be changed without prior approval of the buyers.
1.5.The site owners have the right to block or suspend buyer accounts if they violate the terms of use of the platform, engage in fraudulent activity or engage in activities that may harm other users or the reputation of the site.
1.6.The owners of the site are not responsible for the quality, conformity to descriptions, safety or legality of goods and services offered by sellers. The platform acts only as an intermediary and all responsibility for goods and transactions rests with the sellers and buyers.
1.7.Site owners may charge buyers or sellers commissions for the use of the platform, as well as for additional services such as product promotion or special offers. Commissions are subject to change without notice.
1.8.Site owners are under no obligation to fulfill transactions, including refunds, replacements or returns of merchandise. All matters relating to the return of goods or the resolution of disputes must be settled between the buyer and the seller, unless otherwise provided by law.
1.9.The owners of the site have the right to restrict access by buyers or sellers to certain products, services or features of the platform at any time without prior approval of the user if necessary for security, fraud protection or compliance with the law.
1.10.The site owners have the right to moderate, remove or modify product offers, comments, reviews and any other material posted by users if they violate the rules of use of the platform or the law.
1.11.The site owners have the right to collect, process and use personal data of buyers in accordance with the privacy policy of the platform. This data may be used to improve the quality of service, personalize offers or commercial purposes.
1.12.Site owners are responsible for ensuring that the platform is available to users by keeping it up and running and minimizing technical disruptions. However, the owners are not responsible for any temporary interruptions or disruptions caused by unforeseen circumstances.
1.13.Provision of product information: Site owners are required to provide information about products and services on the platform, but are not responsible for the accuracy, completeness or currency of the data provided by sellers. The information must be available to the buyer before the purchase is finalized.
1.14.The site owners are obliged to provide contact details for user support and to respond promptly in case of technical problems with the site. However, the owners are not responsible for disputes arising between buyers and sellers.
1.15.Site owners must provide buyers with access to their order history, purchase status information.
1.16.Site owners must ensure that their platform provides an intuitive interface and functionality so that shoppers can easily find products, make purchases and utilize other features of the site.
1.17.Unsolicited marketing or misuse of contact information may lead to account suspension.
1.18.Contact details provided by buyers/sellers should only be used for transaction- related communication.
1.19.If MYCRANE platform is unable to provide clear title to a purchased item, the buyer will receive a full refund of the purchase price. If full payment is not received within seven (7) days, interest on overdue amounts will be charged at 18% per annum or the maximum rate permitted by law, along with any legal or collection costs incurred.

2.RIGHTS AND OBLIGATIONS OF USERS
2.1. Buyers have the right to freely choose goods, including lifting and crane equipment, on the platform without any restrictions from the online shop. Buyers have the right to receive full, reliable and understandable information about the product, including its technical characteristics, price, delivery conditions, service life and possible warranties.
2.2. Buyers have the right to conclude transactions on the basis of their own, free and pure will, without manipulation and pressure. The MYCRANE platform undertakes not to interfere in the purchase decision process and transactions must be concluded on the basis of the buyer's explicit consent. This right is protected by the fundamentals of the Civil law.
2.3. Registration Process
Users must register with accurate details.
Multiple accounts by the same user are prohibited.
MYCRANE reserves the right to suspend or terminate accounts violating policies
2.4. Buyers have the right to purchase goods that meet safety standards and do not pose a threat to health or life. This obligation rests with sellers
2.5. The buyer must comply with MYCRANE's platform policies, including compliance with the terms of registration, prohibition of false information and other behavior contrary to the purpose of the platform.
2.6. The buyer is obliged to respect the rights of other users of the platform, not to violate the rules of behavior on the site and not to commit actions that may damage the reputation of other buyers, sellers or the platform itself.
2.7. The buyer undertakes to respond in a timely manner to requests from the seller or the MYCRANE platform and MYCRANE DMCC company related to the fulfillment of the terms of the contract, including clarification of delivery data or payment status. Delaying or ignoring such requests may have consequences for the fulfillment of the contract.
2.8. The buyer shall not interfere with the platform or attempt to change its functionality, including attempts to bypass the payment, delivery or other service.
2.9. License for Images & Information
By listing a product, sellers grant MYCRANE a non-exclusive, worldwide, royalty-free license to use listing images and product details for promotion.
Sellers are responsible for ensuring they have the rights to use any trademarks or copyrighted material in their listings.
2.10. Buying & Selling Process
MYCRANE is not a party to transactions between buyers and sellers.
Sellers must ensure product ownership and the ability to transfer clear titles.
MYCRANE is not liable for payment disputes between buyers and sellers.

4.DISCLAIMER OF MYCRANE DMCC’S PLATFORM
4.1.MYCRANE DMCC inform that this platform for the sale of cranes and other lifting equipment is solely an intermediary, providing communication between buyers and sellers. The platform does not assume any obligation to fulfill the contracts concluded between them.
4.2.The Platform is not responsible for all goods placed on the MYCRANE platform are the property of sellers, who are fully responsible for the quality, compliance of the goods with the stated characteristics, fulfillment of the terms of the contract and fulfillment of obligations to buyers.
4.4.The MYCRANE platform is not responsible for the actions of third parties, including suppliers, courier services, service companies or other participants who may be involved in the process of fulfillment of the transaction.
4.5.The Platform is not responsible for any claims, disputes or damages that may arise between the buyer and the seller. In the event of a dispute, the Platform may act as a mediator, offering assistance in resolving the conflict, but this is the right and not the responsibility of the Platform. All issues regarding returns, warranties, delivery times or other terms of the transaction must be resolved directly between the buyer and seller.
4.6.The Platform is not fulfillment of delivery, warranty, return of goods or other transactions that are handled directly between the buyer and seller.
4.7.The platform is not responsible for the inability to fulfill the transaction due to technical failures, errors on the site, malfunction of payment systems or other external factors that may affect the transaction process.
4.8. All items are sold "as is, where is.". We strongly encourage bidders to inspect items before placing bids.
The use of the platform is at your own risk. The platform is not responsible for any losses or damages related to the use of the site, conclusion of transactions, default of the seller or buyer, or any other activities related to the conclusion and execution of contracts concluded through the platform.

6. FRAUD PREVENTION METHODS
6.1.The MYCRANE platform may require users (buyers and sellers) to undergo verification procedures, including verification of personal data such as passport details, TIN, company details (for legal entities), as well as confirmation of contact information (phone, email). This eliminates the possibility of registering fake or fraudulent accounts.
6.2.To enhance security, the platform can implement two-factor authentication (2FA), which requires the user to confirm their identity through an additional channel (e.g. SMS code or authentication app) when logging into a personal account or making payments.
6.3.The MYCRANE platform may use automated systems to monitor transactions that analyse user behaviour and identify suspicious activities, such as unusual purchase volumes, frequent returns or unsubstantiated complaints. If such activities are detected, the platform may temporarily block the account or conduct additional verification.
6.4.To prevent payment fraud, the MYCRANE platform may use systems that track and analyse suspicious transactions, such as attempts to make payments using stolen cards or false credentials. A system of pre-screening and blocking of suspicious payment data can also be introduced.
6.5.The MYCRANE platform should ensure the use of secure data transfer protocols (SSL/TLS) for all transactions involving sensitive information to prevent user data leakage. It is also important to inform users about the risks of phishing and fraudulent sites and recommend safe ways to interact with the platform.
6.6.The MYCRANE platform may implement a rating and feedback system for buyers and sellers. The system will rate the honesty and reputation of participants based on transaction history, which will help to watch out for scammers and fraudulent sellers. The platform can also block accounts with bad reviews or suspicious activity.
6.7.The MYCRANE platform may implement a procedure to verify goods posted on the platform for compliance with the stated characteristics and standards. Sellers are required to provide accurate product information, and falsification of characteristics or attempts to sell non- existent goods will be discouraged.
6.8.The MYCRANE platform can regularly inform users about typical fraud schemes (e.g., via email or notifications in their personal accounts), warning them against unreliable actions. It is also important to provide the possibility to quickly block suspicious accounts.
6.9.The MYCRANE platform can set strict rules on returning goods, obliging sellers to provide clear terms of return and guarantees. In case of disputes, the MYCRANE platform can help the buyer to get a refund or exchange the goods, subject to buyer protection conditions.
6.10.The MYCRANE platform can implement a system to monitor users' IP addresses and geolocation to prevent fraud related to false orders or attempts to use fake accounts for manipulation.
6.11.The MYCRANE platform can integrate external anti-fraud systems that analyse and prevent fraud by using algorithms to identify suspicious activity based on transaction data, geographical location and other parameters.
6.12.The MYCRANE platform can provide users with security materials and advice, such as how to recognise fraudulent schemes, how not to disclose personal data or banking information, and how to act in case of suspected fraud.

7.AUCTION RULES
7.1. Unreserved Auctions:
All items are sold to the highest bidder on auction day, with no minimum bids or reserve prices.
Sellers are strictly prohibited from bidding on their own items.
Bids are irrevocable, and all sales are final.

7.2. Payment and Removal
Full payment must be made within seven (7) days of the auction’s conclusion.
Purchases cannot be removed from the site until the full invoice amount is paid.
Cash payments will not be accepted.
Payments must be made from the same MYCRANE Marketplace account used for bidding.

All bidders must present valid photo identification before the auction (e.g., passport, driver’s license, or identity card) to complete registration.

7.10.3 The Buyer has the right to bid on the goods within the auction, increasing his bids in accordance with the established rules. The bidder may continue to bid until the auction ends.
7.10.4 The Buyer has the right to confidentiality of his/her identity and bid during the auction. The MYCRANE platform shall ensure that the Buyer's personal data will not be disclosed to unauthorised persons, except as required by law.
7.10.5 The Buyer has the right to withdraw from the auction before the end of the auction and to withdraw his bid, if it does not contradict the auction rules. However, if the bid is a winning bid, the buyer is obliged to complete the transaction.
7.10.6 The buyer has the right to receive notifications about the progress of the auction, including reminders about the current bid, time remaining, and if he has become the leader of the auction.
7.10.7 The Buyer has the right to familiarise himself with the terms and conditions of purchase and contract after the end of the auction, including the price of the goods, payment terms, delivery terms and possible additional costs (e.g. commissions, taxes).
7.10.8 In case of a dispute with the seller about the goods or the terms of the transaction, the buyer has the right to contact the platform for assistance in resolving the conflict, if provided for by the rules of the MYCRANE platform. The MYCRANE platform may act as a mediator, but is under no obligation to resolve all issues.
7.10.9 The buyer has the right to cancel the transaction if the goods do not meet the stated characteristics or if the seller violates the terms of the auction (for example, does not confirm the delivery of the goods within the specified period). This right is governed by the terms and conditions of the MYCRANE platform and consumer protection legislation.
